1. SCOPE OF THE TERMS AND CONDITIONS
The Pix'n Love website is published by Les Editions Pix'n Love. These terms and conditions (hereinafter the "Conditions") govern any purchase made by a non-trading natural person (hereinafter the "Purchaser") from the company "Les Editions Pix'n Love" (hereinafter "Pix'n Love"). Any purchase via the website www.pixnlove.com implies unreserved acceptance of the Conditions by the Purchaser. The conditions may be adapted or modified at any time by Pix'n Love. In case of modification, the conditions applicable will be those online at the date of the order. The conditions are subject to French law. In case of dispute, the French courts shall have exclusive jurisdiction.
2. PRODUCT PRESENTATION
The products sold by Pix'n Love are presented on the website along with their main features. Pix'n Love reserves the right to modify its catalog and product characteristics, including the presentation, release date and packaging. The product offers and prices published on the website are valid within the limits of the available inventory.
3. PREORDER
Pix'n Love allows you to buy products in advance via preorder. This ensures that you receive it as soon as it is officially released. The official release date is indicated in the product description on the website. However, Pix'n Love reserves the right to change it.
4. ORDER
You may review the details of your order and its total price (and correct any errors) before confirming your purchase. Pix'n Love will confirm receipt of your order via an e-mail that is proof of sale (the "Order Confirmation").
5. DELIVERY OF PRODUCTS
5.1. Order Processing
After confirming receipt, Pix'n Love processes your order as soon as payment is received. It will be automatically transferred to the logistics center in charge of shipping orders; it will not be possible to cancel it, nor to modify the delivery address.
5.2. Payment
Full payment is required at the time of order or preorder via credit card or Paypal. In the event of a payment issue, Pix'n Love will immediately stop processing the order and the sale will be automatically cancelled, without any legal intervention. Your secure online payment can be made in complete safety by entering the card number, expiration date and security code in the online form. Your data is encrypted and processed on a completely secure server by a banking institution. No credit card data is transmitted or stored by Pix'n Love. Pix'n Love has no access to this confidential information. Upon acceptance of payment, the information you provided is deleted by the bank, which is why we request that you re-enter your information each time you place a new order on the website.
The website is made secure by:
- SSL encryption technology (SECURE SOCKETS LAYER), which encrypts information being sent;
- the encryption capabilities of the User's Internet browser;
- the secure online payment system that allows direct connection of the user's computer to the credit card center for processing and request for authorization;
- carrying out transaction in accordance with banking industry security standards.
5.3. Delivery
5.3.1. Delivery Methods
The items ordered on the website can be delivered to most countries worldwide. The items are shipped to the delivery address indicated in your order. Items will be shipped from England, France or the United States depending on your location and the available inventory.
5.3.2. Shipping Costs
Shipping costs are based on the weight and volume of the package as well as the country of destination.

5.3.3. Delivery Times
Pix'n Love agrees to deliver products that are ordered and available as soon as possible within 40 days of the Order Confirmation. Packages are generally prepared within 24 hours on regular business days. They are then dispatched to the shipping companies who will deliver the package to your home.
Delivery times vary depending on the shipping company and the final destination of the package. For all shipping companies, it may take a few more days depending on the destination or time of year. No delivery is possible on public holidays. Orders placed on the Website are shipped from Mon-Fri - excluding holidays. If an order includes multiple products that will be available on different dates, the delivery time for the entire order is based on the latest delivery time. In case of a delay of delivery beyond forty days from the Order Confirmation, you may choose to cancel your order. Pix'n Love will then reimburse you via Paypal or an equivalent voucher.
WARNING: If you order one or more available items along with one or more items on preorder, your entire order will only be delivered when all of the items on preorder become available.
5.3.4. Unavailable Items
Pix'n Love will inform you by e-mail of any product that is out of stock and agrees to, as soon as possible and at the latest within 40 days of your payment:
- refund you the price of the unavailable product by Paypal transfer, or by an equivalent voucher valid on our Website.
- or provide you with a product of equivalent quality and value.
5.3.5. Refusal to accept delivery
WARNING: if you receive a package that has been damaged during transport (open package, item on the delivery note that is missing, broken items, etc.), simply follow the procedure below to avoid return shipping costs:
- Do not accept the package.
- Do not sign the delivery note. Describe the issue on the delivery note in the form of "handwritten reservations", accompanied by your signature.
- Report the issue to the shipping company by sending a registered letter with return receipt describing the claim within two (2) working days following the delivery date.

5.3.6. Return Policy
In accordance with Article L.121-20 of the Consumer Code, you have the right to return the item within fourteen days of receipt without having to justify your reasons or pay any fees, with the exception of shipping costs.
Please indicate your order reference on paper and place it inside your return package (a printed copy of your invoice for example).

In accordance with Article L 121-20-2 4° of the Consumer Code, all audio and video recordings and computer software must be returned in the original, sealed packaging, unused and accompanied by a copy of the purchase invoice. Audio and video recordings or computer software that is returned open, incomplete, damaged or degraded will not be accepted. Pix'n Love agrees to replace the returned items or, if you prefer, to refund you within 30 days of receipt of the items by our services. We do not accept cash on delivery shipments.
6. PRICES AND RATES
Our prices are indicated in Dollars, Euros and Pounds. Depending on the country of destination, they will be shown with or without sales tax. They do not include shipping costs. Pix'n Love reserves the right to modify the prices mentioned on the Website, with the understanding that the price in effect on the day your order is placed is the price that will apply, within the limits of available inventory.
For countries outside the European Union, the buyer may be liable for taxes and customs duties upon arrival of the goods in their country, which they must pay. Customs policies vary from country to country. We advise you to contact your local customs office for more information.
7. WARRANTY
Pix'n Love reserves the right to make changes and improvements to its products at any time without notice. Pix'n Love makes no warranty, condition or representation, express or implied, regarding the notices, their qualities, their marketability or their fitness for a particular purpose. All characters and brand names appearing in the products are fictitious and any similarity with existing persons or organizations is purely coincidental. Pix'n Love shall not be held liable for the consequences of any fortuitous event, act of God, fire, flood or natural disaster, total or partial disruption or strike in particular of postal services and means of transport and/or communications, or any other cause having consequences on its fulfillment of the order. In addition to the legal warranty provided by article R 211-4 of the Consumer Code, which must be notified to Pix'n Love within a "short period", for products purchased on the Website, Pix'n Love guarantees the original purchaser of computer software that the recording medium on which the software programs have been recorded will not encounter, under normal conditions of use, any failure in terms of materials or workmanship for a period of 180 days from the date of purchase. Pix'n Love's entire liability under this limited warranty shall, at its sole discretion, be to repair or replace any defective media, provided that the original product is returned to Pix'n Love in its original condition at the address indicated below, accompanied by a dated proof of purchase, a description of the failure and a return address. This warranty does not apply to media that has been misused, damaged or excessively worn.
THIS LIMITED WARRANTY DOES NOT APPLY TO THE SOFTWARE PROGRAMS THEMSELVES WHICH ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. TO THE EXTENT PERMITTED BY APPLICABLE LAW, PIX'N LOVE MAKES NO GUARANTEES (INCLUDING, WITHOUT LIMITATION, WARRANTIES IMPLIED BY LAW, STATUTE, USAGE OR OTHERWISE) REGARDING THE MARKETABILITY, QUALITY AND/OR FITNESS FOR A PARTICULAR PURPOSE OF THIS COMPUTER SOFTWARE PRODUCT.
This limited warranty is in addition to and does not infringe upon your statutory rights.
To return an item to Pix'n Love Customer Service, you must contact Customer Service.
In order to make a claim under the product warranty, you must keep proof of purchase of the product.
The warranty does not extend to:
- Misuse of the product.
- Unauthorized tampering with the product.
- Normal wear and tear of the product or negligence or lack of maintenance.
- Malfunction resulting from force majeure.
- Product not meeting the requirements of the customer's equipment, including physical incompatibility.
- Customer selection error.
8. INTELLECTUAL PROPERTY
In accordance with the provisions of the Intellectual Property Code, Pix'n Love grants you a non-exclusive license to use the products sold on the website. This license includes the right to use the products for strictly personal use. This right is non-transferable. You may use and install only one copy of the product that is downloaded to a computer or delivered by Pix'n Love. Any reproduction or representation, in whole or in part, on any medium, is prohibited. Failure to comply with this restriction constitutes an infringement for which the offender is civilly and criminally liable. However, pursuant to Article L.122-6-1 of this Code, you have the exclusive right to reproduce a backup copy, when it is necessary to preserve the use of the software. The products, product content, and all content on the website are protected by copyright and intellectual property laws.
9. DATA PROTECTION ACT
In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, you have the right to access, modify and rectify your personal data. This information will not be disclosed to other companies other than shipping companies, but Pix'n Love may use it for promotional purposes (newsletter and text messages), unless you object by contacting us here.
